Terms and Conditions for Ticket Sales through the Online Store
I. Introductory Provisions
- These Terms and Conditions (hereinafter referred to as “Terms and Conditions”) of the association Sdružení sportovních klubů Vítkovice, z.s., with its registered office at Závodní 2891/86, Vítkovice, 703 00 Ostrava, ID No.: 00534544, registered in the association register maintained by the Regional Court in Ostrava, Section L, File No. 18, regulate in accordance with Section 1751 Paragraph 1 of Act No. 89/2012 Coll., the Civil Code (hereinafter referred to as the “Civil Code”), the mutual rights and obligations of the contracting parties arising in connection with or on the basis of a purchase agreement concluded between the Seller and another person through the Seller’s online store. The online store is operated by the Seller on the website located at the internet address https://www.zlatatretra.cz/.
- These Terms and Conditions form an integral part of the purchase agreement concluded between the Buyer and the Seller, and by purchasing the Tickets, the Buyer also confirms that they have familiarized themselves with these Terms and Conditions and expressly acknowledge that these Terms and Conditions are part of the contractual arrangement between them and the Seller.
- Definitions of Terms:
- Event refers to a sports event and all other events (conferences, training sessions, etc.) organized by the Seller.
- Seller refers to the association Sdružení sportovních klubů Vítkovice, z.s., with its registered office at Závodní 2891/86, Vítkovice, 703 00 Ostrava, ID No.: 00534544, registered in the association register maintained by the Regional Court in Ostrava, Section L, File No. 18.
- Buyer refers to a natural or legal person who concludes a purchase agreement with the Seller. If the Buyer is a natural person and does not conclude the purchase agreement as part of their business activities or independent professional activities, they conclude the purchase agreement as a consumer under Section 2 Paragraph 1(a) of Act No. 634/1992 Coll., on Consumer Protection, as amended, and Sections 1810 et seq. of Act No. 89/2012 Coll., the Civil Code, as amended (hereinafter referred to as the “Civil Code”).
- Ticket refers to a document authorizing the holder and other persons listed on the Ticket to enter a specific Event, possibly a specific place, intended for one-time use.
- Regular Ticket Price refers to the price of a Ticket that is not a discounted ticket price.
- Web Portal refers to the Seller’s online application at https://www.zlatatretra.cz/, used for providing information about Events and ordering Tickets for these Events. Other undefined terms shall have their usual linguistic meaning unless otherwise derived from the context.
II. Conclusion of the Purchase Agreement
- Tickets at the regular price and/or discounted price can only be purchased electronically through the Web Portal.
- All presentations of services listed on the Web Portal are for informational purposes only and do not constitute a proposal to conclude a contract; therefore, the Seller is not obligated to conclude a contract regarding these services. The provisions of Section 1732 Paragraph 2 of the Civil Code shall not apply.
- The purchase of a Ticket authorizing entry to an Event is conducted by the Buyer for specific Event dates.
- To purchase a Ticket through the Web Portal, the Buyer must fill in their identification and contact details, select a specific Event date, and specify the total number of Tickets.
- The purchase agreement, in the case of purchasing a Ticket via the Web Portal, is concluded at the moment the purchase price for all ordered Tickets is paid by the Buyer to the Seller.
III. Purchase of a Ticket
- The Seller is not liable for the authenticity and validity of Tickets purchased outside the Web Portal.
- The Seller may, at its discretion, issue one or more types of Tickets for individual Events, which may differ in price or the scope of associated services. Information about individual types of Tickets is available on the Web Portal.
- The number of Tickets for an Event may be limited. Tickets can only be purchased if they are still available in the Seller’s offer and have not been sold out.
- Tickets can be purchased online through the Web Portal.
- The Buyer can purchase a maximum of 20 Tickets for a single Event in one order unless specified otherwise in particular cases. Purchasing Tickets requires providing the necessary contact details to complete the order.
- Online payments are processed for us by the Comgate payment gateway. The service provider, Comgate a.s., is a licensed Payment Institution operating under the supervision of the Czech National Bank. Payments made through the payment gateway are fully secured, and all information is encrypted. More information and contacts are available at www.comgate.cz. The buyer will receive an electronic ticket along with a confirmation of the order completion once the payment is credited to the Seller’s account. - Orders for Tickets that are not paid within 20 minutes of ordering will be automatically canceled by the Seller.
- Immediately after purchasing Tickets, the Buyer must check the respective email inbox for a confirmation email with the attached Tickets for printing.
- Tickets are equipped with a specific QR code that will be verified upon entry to the Event. Entry will be granted to the person presenting the Ticket with the relevant code first. Any subsequent persons presenting the Ticket with the same QR code in any form will not be admitted. The Seller is not liable for damages caused by unauthorized copying of the electronic Ticket delivered to the Buyer who placed the order.
- The purchase price of the Ticket is final, including VAT, and covers all related fees.
- The Seller provides information support for ticket purchases on business days from 9:00 AM to 2:00 PM via email at vstupenky@zlatatretra.cz and by phone at +420 731 404 443.
IV. Withdrawal from the Purchase Agreement
- The Buyer, who is a consumer, acknowledges that according to Section 1837 Paragraph j) of the Civil Code, they cannot withdraw from the purchase agreement concluded via the Web Portal within 14 days without stating a reason, as this is a contract for the use of leisure time, where performance is to occur on a specified date or within a specified period.
V. Complaints Procedure
- All complaints are governed exclusively by these Terms and Conditions, particularly this section. The paid purchase price of the Ticket is non-refundable unless stated otherwise in these Terms and Conditions.
- Complaints can only concern Tickets purchased via the Web Portal. Only the Buyer who purchased the Ticket via the Web Portal is entitled to file a complaint.
- The Buyer is entitled to a refund of the paid purchase price of the Ticket only in the cases and under the conditions specified below.
- The Buyer is not entitled to exchange the Ticket. In case of damage, destruction, loss, theft, or other devaluation of the Ticket, the Ticket will not be replaced, nor will compensation be provided.
- The Seller is not liable if the Ticket is not delivered to the Buyer due to reasons on the Buyer’s side, such as an overfilled mailbox or spam filter issues.
- The Buyer is obliged to check the correctness and completeness of the Ticket (event name, venue, event date and time, price, and quantity of Tickets) immediately upon receipt. Any complaint regarding the content of the Ticket must be filed within five business days from the receipt date.
- If the Buyer has not received the Ticket within two hours of payment, they must contact the Seller within 48 hours. The Buyer must provide their name and email used during the Ticket purchase.
- In case of a canceled Event, the Buyer will be notified using the contact information provided (email, phone, postal address, etc.).
- If an Event is canceled, the Buyer may request a refund of the purchase price without undue delay via email at vstupenky@zlatatretra.cz.
VI. Special Provisions on Obligations in Consumer Purchase Agreements
- These provisions apply to purchase agreements concluded with Buyers who are consumers.
- The concluded purchase agreement will be stored with the Seller, and the Buyer may request access to it.
- The purchase agreement can be concluded in the Czech language.
- Steps for concluding the purchase agreement:
- Access the Web Portal and select the desired Event date.
- Fill in identification and contact details.
- Select additional required fields (e.g., payment method).
- Check the box confirming agreement with the Terms and Conditions and data processing information.
- Provide payment for the Ticket.
- The Buyer has the right to identify and correct errors before submitting the order.
VII. Personal Data Processing Information
- The Seller, as the data controller, provides information on the processing of personal data and the rights of data subjects. All details are available at https://www.ssk-vitkovice.cz/ under the GDPR section.
IX. Final Provisions
- All agreements between the Seller and the Buyer are governed by Czech law. If the relationship includes an international element, Czech law applies.
- The Seller reserves the right to unilaterally change or update these Terms and Conditions at any time, with the current version published on the Web Portal.
